Privacy Policy
At Ethium, we recognize that privacy is important. This Privacy Policy (this “Policy”) applies to all of Ethium’s marketing communications and identifies the types of information Ethium may collect from you through the use of Ethium’s electronic communications and websites (collectively, the “Sites”) and how Ethium uses this information. By using the Sites and providing your identity information, you consent to the use of personal information as provided herein. Information Gathered
In order to provide our information and online services, we may collect the following types of information:
- Cookies – When you visit or use any Ethium Site, it may send a cookie – a small file containing a string of characters – to your computer that uniquely identifies your browser. This is used to measure our Sites’ effectiveness through website analytics. Ethium may use cookies or similar files or scripts throughout our Sites to enhance their use, to improve search functionality, to compile and analyze statistics regarding the use of our Sites, to hold information that you would otherwise need to re-key, or to help us recognize visitors on later visits to our Sites. If you do not wish to accept cookies from our Sites, you may configure your web browser so that it does not accept cookies; however, you may lose certain functions available on our Sites.
- Log information – When you access Ethium websites, our servers automatically record information that your browser sends whenever you visit a website. These server logs may include information such as your web request, Internet Protocol address, operating system, browser type, browser language, the date and time of your request and one or more cookies that may uniquely identify your browser. Ethium webservers may collect domain names and/or IP addresses of users to measure what pages and features are accessed by our visitors. This information helps us administer the Sites, improve content and gather broad tracking information for aggregate use.
- User communications – When you send email or other communications to Ethium we may retain those communications in order to process your inquiries, respond to your requests and improve our services.
- Other sites – This Policy applies to Ethium Sites only. We do not exercise control over external sites that may be linked from within our Sites. Those other sites may place their own cookies or other files on your computer, collect data or solicit personal information from you.
Choices for Personal Information
When you contact Ethium , register for an event or request materials to be sent to you, we ask you to provide personal information. We will use this information to deliver the service you requested. You may also be contacted by Ethium again about future opportunities similar to what you requested. Whenever we contact you, you will have the choice to opt out of future communications. We will not collect or use your information for purposes other than those described in this Policy unless we have obtained your consent. Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent.
Information Sharing
Ethium keeps a record of contacts with prospects and customers within a customer resource management system. Depending on the size and location of the customer, Ethium may transfer the business opportunity to a dealer with our distribution network for localized service. In that situation, Ethium may transfer your information to the dealer in order to contact you and establish a local business relationship. Ethium does not share or sell your personal information to any third-party business or marketer outside of its distribution network.
Information Security
Ethium employs commercially reasonable security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of your personal information. These measures include internal reviews of our data, storage and processing practices and security measures. You should know however, that emails and other information you send to us are not encrypted and such transmissions cannot be considered a secure means of transmitting confidential information. You should be aware of the limitations of security, authentication, encryption, and privacy measures used in connection with the Internet and that any information you transmit through the Sites may be damaged, corrupted, intercepted, and/or accessed by another person without your permission.
Use of Client Information
Client information includes any and all information received by Ethium from you, whether such information is received by accessing the Sites, email, online forms, telephone, facsimile, mail or otherwise. Ethium may store this information to enable Ethium to better service you. We may use your information to process your service requests, handle orders, deliver products and services, process payments, communicate with you about orders, provide access to secure areas of the Sites, recommend merchandise and services that might be of interest to you, to personalize your visit to our Sites, and to enable us to review develop and continually improve the products services and offers we provide online. We also use this information to prevent or detect fraud or abuses of our Sites and to enable third parties to carry out technical, logistical or other functions on our behalf. Except as provided in this Policy, we do not disclose any nonpublic personal information about you to anyone except as permitted by law or required by court order. Ethium may choose to disclose all of the information we collect, as described above, to our affiliates and to companies that perform marketing services on our behalf or to other similar companies with whom we have joint marketing agreements. Your information may be disclosed to companies that provide support services to us, such as data processors, technical systems consultants and programmers. We may also provide analysis based on the information we collect to our strategic alliance partners and other risk sharing partners. Ethium also shares certain personal and/or financial information with its merchant account and banking vendors to process payment and with any common carriers to ship products to you. We also may use IP addresses to analyze trends, administer the Sites, track user movement, and gather broad demographic information for aggregate use. As we develop our business, we may buy or sell assets and, depending on the transaction, your personally identifiable information may be one of the transferred assets. In the event that we are acquired by another company, your personal information may be part of the assets transferred to the acquiring party. If Ethium should ever file for bankruptcy or merge with or be acquired by another company, we may sell the information you provide to us to a third party or share your personal information with any entity resulting from such transaction.You authorize us to disclose any information about you to law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate, in connection with an investigation of fraud, intellectual property infringement, or other illegal activity. We have the right to share your name and contact information with our attorneys and law enforcement officials, if needed, in the event we believe you have breached your obligations to us.To the extent that Ethium chooses to disclose the information we collect to our affiliates and to companies that perform marketing services on our behalf, we will also implement measures to preserve confidentiality and to allow you to unsubscribe from such contacts. If you do not want to receive such mailings, or if you prefer that we not disclose nonpublic personal information about you to nonaffiliated third parties, you may direct us not to make those disclosures (other than disclosures permitted by law) by simply telling us not to do so when you give us your personal information. Or, at any time, you can opt-out of receiving further marketing from Ethium by contacting us and requesting to have your name removed from our lists. We will generally be able to give effect to your withdrawal on 30 days’ notice. Unless otherwise stated, this Policy does not apply to information posted by users on publicly accessible portions of our Sites, including but not limited to, online forums and bulletin boards.
Data Integrity
Ethium processes personal information only for the purposes for which it was collected and in accordance with this Policy. We review our data collection, storage and processing practices to ensure that we only collect, store and process the personal information needed to provide or improve our services. We take reasonable steps to ensure that the personal information we process is accurate, complete, and current, but we depend on our users to update or correct their personal information whenever necessary.
Changes to this Privacy Policy
Please note that this Policy may change from time to time without prior notice. Each version of this Policy will be identified at the top of the page by its effective date.
Children
Ethium does not knowingly collect personal information from children under the age of 18, and the Sites are not directed at children under the age of 18. If Ethium obtains actual knowledge that it has obtained personal information about a child under the age of 18, that information is deleted from our records.

Governing Law and Jurisdiction
This Policy, and Ethium’s collection and use of client information, shall be governed and interpreted in accordance with the laws of the United States and the State of Texas. Any disputes arising out of this Policy shall be adjudicated only in a court of competent jurisdiction in Bexar County, Texas. By accepting this Policy, you are also agreeing to submit to jurisdiction and venue in Bexar County, Texas.
